Discuss the "legal standards of care" and how they apply to complex emergencies.
Legal standards of care refer to the skills that healthcare professionals must exercise in various circumstances depending on what a prudent practitioner is reasoning. The legal standards of care are flexible according to the situation and they are interpreted differently in various States. Legal standards of care are not similar to the medical standards. During complex emergencies such as human displacement, conflict, war, and disasters caused by climate change, the legal standards of care are crucial in providing beneficial care that is tailored to meet the needs of the victims (Gostin et al., 2019). Legal standards of care emphasize on recognition of the situations that require immediate care and emergency care provision when the resources are scarce. Other times, during complex emergencies, the responders might engage in actions that do not align with the laws of the land. Legal standards of care protect the responders from any civil liability based on their actions during a disaster.
Why is public health law important?
Public health law is a type of public health policy that integrates concepts of healthcare, medicine, law, and public health. The law incorporates public health interventions that are legal. Therefore, public health law implementation is important in maintaining the optimum health of the general population (CDC, 2023). Additionally, public health law provides healthcare professionals with the definition of their scope and legal basis of practice.
What is an ethical dilemma you might anticipate in a disaster situation and how would you respond?
One of the ethical dilemmas that I anticipate during a disaster is social justice. Social justice requires the responders to treat all people fairly and respect the dignity of all the victims of a disaster. The dignity of the victims concerning their security, assess to clean water and food, physical safety, temporary housing, hygiene and clothing, and access to psychological care must be upheld. Social justice as an ethical dilemma is experienced when the responder has to deliver care to the most vulnerable populations first.
